Terms and Conditions of the Allora Be Unique Online Store

These Terms and Conditions set out the rules for using the Allora Be Uniqueonline store, placing orders, concluding sales contracts, making payments,receiving deliveries, withdrawing from a contract and submitting complaints.

I. General provisions

  1. The online store operating atallora.sklep.plis operated by Firma Handlowa Stanisław Pawlina, hereinafterreferred to as the “Seller”.
  2. These Terms and Conditions apply to contracts concluded throughthe Website, including through its English-language version.
  3. The Seller sells products within Poland and to selected foreigncountries available in the delivery options during checkout.
  4. The Customer must read and accept these Terms and Conditionsbefore placing an Order.
  5. Acceptance of these Terms and Conditions is voluntary, but it isnecessary to create an Account or place an Order through the Website.
  6. The Customer is required to use the Website in accordance withapplicable law, these Terms and Conditions and generally acceptedstandards of conduct.
  7. The Customer may not provide unlawful content, including contentthat infringes the personal rights, intellectual property rightsor other rights of third parties.

II. Definitions

  1. Website or Online Store – the online storeavailable at allora.sklep.pl.
  2. Seller or Service Provider – Firma HandlowaStanisław Pawlina, ul. Baczyńskiego 2, lok. 59,99-400 Łowicz, Poland, Tax Identification Number 8341208088.
  3. Customer – a natural person with legal capacity,a legal person or an organisational unit with legal capacity thatuses the Website or purchases Goods.
  4. Consumer – a natural person concluding a contractwith the Seller for purposes not directly related to that person’sbusiness or professional activity.
  5. Entrepreneur with consumer rights – a naturalperson concluding a contract directly related to their businessactivity, where the contract is not of a professional nature forthat person under applicable Polish law.
  6. Goods or Product – a movable item offered for salethrough the Online Store.
  7. Order – the Customer’s declaration submittedthrough the Online Store with the intention of concluding a SalesContract.
  8. Sales Contract – a contract for the sale of Goodsconcluded between the Seller and the Customer through the Website.
  9. Account – an individual part of the Website madeavailable to a registered Customer, containing the Customer’s dataand information about their Orders.
  10. Cart – a Website function that allows the Customerto select Goods, quantities, delivery information, payment methodand other Order details.
  11. Newsletter – an electronic service consisting ofsending commercial and marketing information to an email addressprovided by a consenting Customer.
  12. Business Day – a day from Monday to Friday,excluding public holidays in Poland.

III. Electronic services and technical requirements

  1. The Seller provides the following electronic services free of charge:
    • access to the Website and its content,
    • use of the electronic Order form,
    • creation and maintenance of a Customer Account,
    • Newsletter delivery following consent,
    • contact forms and other Website functions.
  2. The service allowing the Customer to submit an Order is providedfor the time necessary to complete or discontinue the Order process.
  3. The Account service is provided for an indefinite period untilthe Account is deleted by the Customer or the Seller in accordancewith these Terms and Conditions.
  4. To use the Website correctly, the Customer should have:
    • a device connected to the Internet,
    • a current web browser supporting cookies and JavaScript,
    • an active email address,
    • software allowing standard web content to be displayed.
  5. The Customer is responsible for keeping their login details andpassword confidential and for preventing unauthorised persons fromusing their Account.
  6. Complaints concerning electronic services may be submitted tosklep@allora.sklep.pl.
  7. A complaint concerning an electronic service should, where possible,include information identifying the Customer, a description of theproblem and the Customer’s requested solution.
  8. The Seller will respond to a complaint concerning electronicservices within 14 days of receiving it.

IV. Orders and conclusion of the Sales Contract

  1. Orders may be placed through the Website 24 hours a day,seven days a week.
  2. A Customer may place an Order either after registering an Accountor without registration as a guest.
  3. Information about Goods displayed on the Website constitutes aninvitation to conclude a contract and does not constitute a bindingoffer within the meaning of the Polish Civil Code.
  4. To place an Order, the Customer must:
    • select the Goods and their available options,
    • add the Goods to the Cart,
    • provide the required contact and delivery details,
    • select the available delivery and payment methods,
    • review the Order summary,
    • accept these Terms and Conditions,
    • confirm the Order using the button indicating an obligation to pay.
  5. The Customer must provide complete, current and accurate informationnecessary to process the Order.
  6. Immediately after receiving the Order, the Seller sends an electronicconfirmation to the email address provided by the Customer.
  7. The Sales Contract is concluded when the Customer receives confirmationthat the Order has been accepted for processing.
  8. The confirmation of the Order includes the essential terms of theSales Contract and is provided on a durable medium.
  9. The Seller may contact the Customer if the information providedis incomplete, incorrect or prevents the Order from being processed.
  10. If the ordered Goods are unavailable, the Seller will inform theCustomer without undue delay. If payment has already been received,the Seller will refund the amount paid.
  11. Goods offered through the Online Store are legally placed on themarket and, unless clearly described otherwise, are new.
  12. Goods with a minor defect or imperfection may be sold only wherethe imperfection is clearly described before the Customer placesthe Order.
  13. Product photographs are intended to present the Goods as accuratelyas possible. Minor colour differences may occur due to individualscreen settings and do not affect the Customer’s statutory rightswhere the Goods do not conform to the Sales Contract.
  14. Orders placed outside the Seller’s working hours, on weekends oron public holidays are processed from the next Business Day.

V. Prices and payment methods

  1. Product prices are displayed in the currency indicated on theWebsite and include applicable taxes, unless expressly statedotherwise.
  2. Product prices do not include delivery costs unless the Websiteexpressly states that delivery is free.
  3. Before placing an Order, the Customer is shown the total pricepayable, including the price of the Goods, taxes, delivery costsand any other applicable charges.
  4. The Customer may use the payment methods made available duringcheckout, including online payment through Przelewy24 where available.
  5. Payment must be made within the time indicated during checkout orin the payment provider’s instructions.
  6. The Seller may change Product prices, delivery charges and availablepayment methods. Such changes do not affect Orders already acceptedfor processing.
  7. A sales document is issued for each Order in accordance withapplicable tax regulations.
  8. A Customer requesting an invoice must provide the required invoicingdetails during the Order process.

VI. Delivery

  1. Goods are delivered to the address provided by the Customer whileplacing the Order.
  2. Orders placed through the English-language version of the Websiteare delivered internationally by DPD Courier to the countriesavailable during checkout.
  3. The delivery cost is calculated during checkout and depends on thedestination country and parcel details.
  4. The estimated delivery time depends on the destination country.Available delivery information is displayed during checkout or inthe Order confirmation.
  5. Unless another delivery date has been expressly agreed, Goods orderedby a Consumer will be delivered no later than 30 days after conclusionof the Sales Contract.
  6. Delivery details are also available on theDelivery page.
  7. The Customer should provide an accurate and complete delivery addressand a telephone number that may be used by the courier.
  8. The Customer is encouraged to inspect the parcel after delivery.If visible transport damage is found, preparing a damage report withthe courier may help to process the case more efficiently.
  9. Failure to prepare a courier damage report does not deprive a Consumerof their statutory rights against the Seller.
  10. In a contract concluded with a Consumer, the risk of accidental lossor damage passes to the Consumer when the Goods are delivered to theConsumer or to a person designated by them, other than the carrier.
  11. If the Consumer independently selects a carrier not offered by theSeller, the risk may pass to the Consumer when the Goods are handedover to that carrier, in accordance with applicable law.

VII. Right of withdrawal and returns

  1. A Consumer who has concluded a distance Sales Contract may withdrawfrom it without giving any reason.
  2. Allora Be Unique voluntarily extends the period for exercising theright of withdrawal to 30 calendar days from thedate on which:
    • the Consumer or a person designated by the Consumer,other than the carrier, receives the Goods;
    • the Consumer receives the last item, batch or part whereGoods are delivered separately;
    • the Consumer receives the first item where the contractprovides for regular delivery over a specified period.
  3. To exercise the right of withdrawal, the Consumer must inform theSeller of their decision through an unequivocal statement beforethe withdrawal period expires.
  4. The withdrawal statement may be sent:
    • by email tosklep@allora.sklep.pl;
    • by post to the Seller’s address;
    • through the return function available in the Customer Accountor guest return process, where available.
  5. The Consumer may use the model withdrawal form but is not requiredto do so.
  6. Information identifying the Order, such as the Order number or emailaddress used to place it, should be provided to allow the Seller toprocess the return.

  8. The Consumer bears the direct cost of returning Goods when withdrawingfrom the contract, unless the Seller has expressly agreed to bearthat cost.
  9. Cash-on-delivery return parcels will not be accepted.
  10. The Seller will refund payments received from the Consumer withoutundue delay and no later than 14 days after receiving the withdrawalstatement.
  11. The refund includes the cost of the least expensive standard deliverymethod offered by the Seller for the original Order. Additional costsresulting from the Customer’s choice of a more expensive deliverymethod are not refundable.
  12. The Seller may withhold the refund until the returned Goods arereceived or until the Consumer provides proof that they have sentthem back, whichever occurs first.
  13. Refunds are normally made using the same payment method used forthe original transaction, unless the Consumer expressly agrees toanother method that does not involve additional costs.
  14. The Consumer is responsible for any reduction in the value of theGoods resulting from handling them beyond what is necessary toestablish their nature, characteristics and functioning.
  15. The right of withdrawal does not apply in cases specified byapplicable law, including in particular contracts concerning:
    • Goods made to the Consumer’s specifications or clearlypersonalised;
    • Goods that deteriorate rapidly or have a short shelf life;
    • sealed Goods which are not suitable for return for healthprotection or hygiene reasons after the seal has been broken;
    • Goods which, after delivery, are inseparably combined withother items due to their nature;
    • other Goods or services covered by statutory exclusions fromthe right of withdrawal.
The voluntary 30-day return period offered by Allora Be Unique does notrestrict any mandatory consumer rights resulting from applicable law.Detailed instructions are available on theReturns and Complaints page.

VIII. Complaints and non-conformity of Goods

  1. The Seller is responsible to a Consumer for the conformity of theGoods with the Sales Contract in accordance with applicable consumer law.
  2. The Seller’s statutory responsibility for non-conformity of Goodsgenerally applies where the non-conformity becomes apparent withintwo years from delivery of the Goods, unless a longer period applies.
  3. Goods conform to the Sales Contract where, in particular, theirdescription, type, quantity, quality, completeness, functionalityand intended purpose comply with the contract and applicable law.
  4. Where Goods do not conform to the Sales Contract, the Consumer mayrequest repair or replacement.
  5. The Seller may replace the Goods when the Consumer requests repair,or repair the Goods when the Consumer requests replacement, if theremedy selected by the Consumer is impossible or would involvedisproportionate costs.
  6. If both repair and replacement are impossible or would involvedisproportionate costs, the Seller may refuse to bring the Goodsinto conformity with the contract.
  7. Repair or replacement will be carried out within a reasonable time,without excessive inconvenience to the Consumer and at the Seller’s cost.
  8. The Consumer must make the Goods available to the Seller. The Sellerbears the justified costs of collecting, transporting, repairingor replacing Goods subject to a valid complaint.
  9. The Consumer may request an appropriate price reduction or withdrawfrom the Sales Contract where, in particular:
    • the Seller has refused repair or replacement;
    • the Seller has failed to bring the Goods into conformity;
    • non-conformity continues despite an attempted remedy;
    • the non-conformity is sufficiently serious;
    • it is clear that the Seller will not bring the Goods intoconformity within a reasonable time or without excessiveinconvenience.
  10. A Consumer may not withdraw from the Sales Contract where thenon-conformity is insignificant, subject to applicable statutory rules.
  11. A complaint may be submitted:
  12. To facilitate the assessment of a complaint, the Customer should,where possible, provide:
    • the Order number or other information identifying the purchase,
    • a description of the issue,
    • photographs showing the defect or damage, where relevant,
    • the requested remedy,
    • current contact details.
  13. A fiscal receipt is not the only acceptable proof of purchase.The transaction may also be demonstrated using other reliable evidence,including an Order confirmation, payment confirmation or email correspondence.
  14. The Seller will respond to a Consumer’s complaint within 14 daysof receiving it. Failure to respond within the statutory period hasthe consequences provided for by applicable law.
  15. The response will be provided on paper or another durable medium,including by email.
  16. Any commercial or manufacturer’s warranty provided for the Goodsis independent of the Consumer’s statutory rights against the Seller.

IX. Customer Account and Newsletter

Customer Account

  1. Creating an Account is voluntary and free of charge.
  2. The Customer must provide accurate information when registeringan Account and keep that information up to date.
  3. The Customer may request deletion of the Account at any time bycontacting the Seller.
  4. Deleting an Account does not affect Sales Contracts concluded beforedeletion or the Seller’s legal obligations concerning transaction records.

Newsletter

  1. The Newsletter is sent only to persons who have voluntarily consentedto receive it.
  2. The Newsletter may contain information about Products, collections,promotions, events and the activities of Allora Be Unique.
  3. Newsletter subscription is free of charge and is provided for anindefinite period.
  4. The subscriber may withdraw consent and unsubscribe at any time,including by using the unsubscribe link included in the Newsletteror by contacting the Seller.
  5. Withdrawal of consent does not affect the lawfulness of processingcarried out before consent was withdrawn.

X. Personal data

  1. The controller of Customers’ personal data is Firma HandlowaStanisław Pawlina, ul. Baczyńskiego 2, lok. 59,99-400 Łowicz, Poland.
  2. Personal data is processed in particular to:
    • process Orders and perform Sales Contracts,
    • provide electronic services,
    • process payments and deliveries,
    • handle returns and complaints,
    • comply with accounting and legal obligations,
    • send marketing information where valid consent has been given.
  3. Detailed information concerning personal data processing, dataretention, recipients and Customers’ rights is provided in thePrivacy Policy available on the Website.
  4. Questions concerning personal data may be sent tosklep@allora.sklep.pl.

XI. Business customers

  1. The provisions concerning Consumers also apply to an Entrepreneurwith consumer rights to the extent required by applicable law.
  2. In contracts with Customers who are neither Consumers norEntrepreneurs with consumer rights, the Seller’s statutory liabilityunder warranty may be excluded to the extent permitted by Polish law.
  3. A business Customer is required to inspect the Goods promptly afterdelivery and notify the Seller of visible transport damage orquantitative discrepancies without undue delay.
  4. The requirement described above does not apply where it would limitmandatory rights granted to a Consumer or an Entrepreneur withconsumer rights.

XII. Final provisions

  1. These Terms and Conditions are available free of charge on theWebsite in a form that allows them to be saved, reproduced and printed.
  2. Sales Contracts concluded through the Website are governed byPolish law.
  3. The application of Polish law does not deprive a Consumer residingoutside Poland of protection granted by mandatory provisions of thelaw of the country in which the Consumer has their habitual residence.
  4. Disputes arising in connection with these Terms and Conditions orSales Contracts will be resolved by the competent courts determinedin accordance with applicable law.
  5. A Consumer may obtain information about available out-of-courtcomplaint and dispute resolution procedures from competent consumerprotection authorities.
  6. The Seller does not undertake to participate in an out-of-courtconsumer dispute resolution procedure unless such participationis required by law or separately agreed.
  7. The Seller may amend these Terms and Conditions for important reasons,including:
    • changes in applicable law,
    • changes in payment or delivery methods,
    • changes in the technical operation of the Website,
    • changes in the scope of electronic services,
    • changes in the Seller’s identification or contact details.
  8. Amendments do not affect Orders or Sales Contracts concluded beforethe amended Terms and Conditions entered into force.
  9. Registered Customers will be informed of material changes to theseTerms and Conditions in the manner required by applicable law.
  10. The Allora Be Unique name, Website design, photographs, descriptions,graphics and other materials available on the Website may be protectedby intellectual property rights. Their unauthorised use or distributionis prohibited.
  11. The English version of these Terms and Conditions is provided forCustomers using the English-language Website. In the event of adiscrepancy between language versions, the Polish version will beused for interpretation, without prejudice to mandatory consumerprotection provisions.
  12. These Terms and Conditions enter into force on the date they arepublished on the Website.
